May 7, 2009 Oregon House Bill 2433 ("HB 2433") was signed into law by Governor Kulongoski last week. The legislation pertains to the group health plan continuation rules that apply to "small employer plans" governed by state law, but not the federal COBRA rules. Stated briefly, the new law, and the new administrative rules issued thereunder by the Oregon Insurance Division, provide for three significant changes. 1. The required period of continuation of health insurance coverage for employers covered by Oregon continuation laws is permanently extended from six months to nine months. 2. Certain involuntarily terminated individuals have a second opportunity to elect Oregon continuation coverage. 3. The law imposes the continuation coverage notice and election requirements on the insurers, relieving employers from this duty.
